Pleas in Larchmont Crossing Guard Assault

Murray and Colonial Avenues Crosswalk where Crossing Guard was assaulted

Many remember the story in May when two men assaulted a Larchmont Crossing Guard during school dismissal to the horror of parents, caregivers and children walking home from Murray Ave. School.

Patch reports that the men who were charged with the crime pled guilty to lesser charges. Police had confirmed the guard, known to children and parents as Alphonso, was crossing children at the corner of Colonial and Murray Avenues after Murray Avenue School dismissal when he became involved in a dispute with two men.

One of the men, says Police Lt. Robert Koziak, struck the guard in the chest with his fist and he fell to the ground. As the men tried to flee in their black Nissan Rogue SUV, with at least one mother attempting to block his car by standing in front of it, they struck the guard in the right leg, say Police.

The guard was treated for minor injuries at Sound Shore Hospital and missed a few days of work.

According to the report, Anthony Vaccaro was originally charged with obstructing governmental administration and leaving the scene of an accident, both misdemeanors.  He pled guilty to second degree harassment, a violation, and paid a $375 fine.

Lucian Cappello from Facebook page

Lucian Cappello was originally charged with obstructing governmental administration and third-degree assault, both misdemeanors. He pled guilty to second degree harassment, a violation, and paid a $375 fine.

Agreed! If we had a justice system that worked, people of this kind would be in jail where they belong!

These guidos had a decent lawyer and the prosecutor let them plea it down easily. Not sure if civil suit filed. Typical justice system.

I totally agree with Larchmont Resident. How does punching someone down – clearly an assault – become ‘harassment’ ??? And all this in front of school kids? I hope the guard gets a sizeable damage award in civil claim. They only deserve contempt.

I am outraged that these hooligans and low-lifes were able to skate from justice. They could have kiiled this poor man. We don’t need those kind of people in Larchmont, and unless the “punishment fits the crime,” there will be no incentive for them to stay where they belong!
